Louisiana became the third state to gain primacy over the permitting of Class VI wells when the Environmental Protection Agency (EPA) signed a final rule December 28 granting it primary responsibility for the permitting, compliance and enforcement for those wells.
Class VI wells are required for the permanent geologic sequestration of carbon dioxide (CO2). Before the EPA’s announcement, only North Dakota and Wyoming had been granted primacy, although other states are going through the application process. Louisiana submitted its application to the EPA in September 2021.
