Mountain Valley Pipeline (MVP) faces yet another curveball thrown at their attempt to complete the pipeline. The Fiscal Responsibility Act (FRA, the debt-ceiling act), passed by Congress and signed by the President, had mandated issuance of all necessary federal permits for MVP and taken jurisdiction away from the 4th Circuit U.S. Court of Appeals. Notwithstanding that, on Monday 7/10, a panel of 4th Circuit judges unanimously granted a stay to stop construction on the pipeline. The motion filed by Wilderness Society and other environmental groups last week had argued that construction should cease while the 4th Circuit reviews the decision the U.S. Forest Service which allows construction to resume in the Jefferson National Forest.
The stay of construction is limited to the 3-mile stretch of 303-mile pipeline that traverse the nation forest. This might start an unpredictable fight between courts, Congress, and the administration. The pipeline is championed by both senators from West Virginia: Sen. Joe Manchin and Sen. Shelly Moore Capito.
