The Fourth Circuit Court of Appeals on April 3 revoked Mountain Valley Pipeline’s (MVP) water quality permit from the West Virginia Department of Environmental Protection (WVDEP) that would have allowed the project to complete waterbody crossings in the state. In doing so, the court sided with landowners and environmental groups that the WVDEP's decision to issue the permit was flawed and warranted further review.
The decision, which came just days after the same court upheld MVP's water certification in Virginia, is a major blow to the project in that it will delay some of the federal permits and all but guarantee that construction won't be completed this year.
